1. Applicability
The terms of use apply to all content on the platform www.sectio-chirurgica.de of the Institute of Clinical Anatomy and Cell Analysis of the University of Tübingen.
2. Ethical and Moral Obligation
At Sectio chirurgica, surgical procedures are demonstrated on human specimens. During their lifetime, they willed their bodies to be donated for the purposes of research and medical training to the Institute of Clinical Anatomy and Cell Analysis of the University of Tübingen. The Institute of Clinical Anatomy and Cell Analysis of the University of Tübingen is obligated to comply with the ethical obligations of the body donor programme and the agreement with the body donors.
3. Offered Content
The website www.sectio-chirurgica.de is owned by the Institute of Clinical Anatomy and Cell Analysis of the University of Tübingen, Faculty of Medicine. Its content is offered free of charge and restricted. It is directed towards medical and medically-related study programmes and towards medical and medically-related professionals. The Institute of Clinical Anatomy and Cell Analysis reserves the right to demand proof of the right of access in form of official documents.
The access and use of media offered on www.sectio-chirurgica.de is subject to the terms of use. Access and use will only be granted if you expressly agree to these terms of use.
4. Copyright
The services offered on www.sectio-chirurgica.de, including information, texts, software, images, videos, graphics, sound and other material are protected commercially by copy‑, trademark and patent right. The copy‑, trademark, patent and exploitation rights belong exclusively to the MFT and the respective licensers. You obligate yourself to comply with the legal requirements of the copy‑, trademark and patent rights.
5. Placement and Amendment of the Terms of Use
a) The terms of use are available online on www.sectio-chirurgica.de and as an attachment to the registration form during registration.
b) The Institute of Clinical Anatomy and Cell Analysis reserves the right to amend the terms of use at any time. These changes become valid once they have been published online. By continued use of the offered services you agree to the amendments to the terms of use and are bound by these terms.
c) The Institute of Clinical Anatomy and Cell Analysis is able to amend or suspend the services offered or certain features at any time without notice. It is able to restrict the use and the access to the offered services as well as the duration and extent of use at any time, respectively.
6. Warranty and Product Liability
a) The Institute of Clinical Anatomy and Cell Analysis provides the systems “as they are” to use. No particular features are explicitly guaranteed and neither is the absence of errors nor the freedom of rights of third parties warrantied. It is not warrantied that the platform is suitable for the purposes of its users and that it works with existing software. The Institute of Clinical Anatomy and Cell Analysis is not liable for any damages occurring because of the use of the platform.
b) The Institute of Clinical Anatomy and Cell Analysis does not warranty the correctness and completeness of the provided contents. The institute is not liable for any damages, direct or indirect, occurring because of incorrect content.
c) The Institute of Clinical Anatomy and Cell Analysis does not guarantee the backup of uploaded content. The user is responsible for an adequate backing up of the data. No warranty is given in case of a loss of data and consequential damages.
d) The Institute of Clinical Anatomy and Cell Analysis does not warrant the availability of any systems or contents at a specific time or during a specific timeframe. The institute is not liable for any damages occurring because of a non-availability of the systems or contents. However, the Institute of Clinical Anatomy and Cell Analysis endeavours to keep downtime as low as possible and that all features are always available.
e) You expressly agree that the use of the systems and the contents is at your own risk.
7. Registration and Account
a) The Institute of Clinical Anatomy and Cell Analysis provides information, medical knowledge and training videos for registered users. You assure that the information entered by you during registration is correct and that you will update it as soon as any changes occur.
b) You assure that you will not pass your account-identity and password on and agree that you are responsible for any actions regarding the provided services that have been performed using your user-id and password. If you notice any kind of misuse regarding your account information, you are responsible for notifying the administrator immediately.
8. Termination of User Rights
a) User rights are terminated if you delete your account.
b) The Institute of Clinical Anatomy and Cell Analysis has the right to partly and completely deny access to its systems or terminate your account if there is an infringement of the terms of use or if the systems are used, using your id and password, either by yourself or a third party, in a way which could be detrimental to the institute.
9. Use of Information and Material
a) The access and user rights granted to you are non-transferable. You are allowed to use (e.g. read, download, print) the material, except for video and livestream (see 9. d) for video content), provided on the platform. This right is only for your own personal use in the context of teaching, learning and research. Commercial use is explicitly exempt.
b) You promise not to copy, use, sell, transfer, publish the material for other use or make it available in any way. This includes external newsgroups, mailing lists, electronic bulletin boards, Social Media and other.
c) Communication systems (e.g. chat) are exempt from commercial use or from use differing from the objective of the provided content. The circulation of email addresses of other registered users is prohibited.
d) Media library and livestream
The copyright of the provided recordings and livestreams lies with the University of Tübingen, Medical Faculty, Institute of Clinical Anatomy and Cell Analysis.
The Institute of Clinical Anatomy and Cell Analysis provides content on its platform www.sectio-chirurgica.de that can be accessed and watched by registered and activated (by an administrator) users.
The content provided in the media library and in the livestream are protected by copyright law. Therefore, storage or redirecting of said contain is not allowed.
Complete or partial integration of the contents of the media library and the livestream in other services (e.g. channels, websites, applications) is illegal. Additionally, downloading, editing, copying is not permitted.
Screening of the livestream as part of a lecture hall, group or Sectio chirurgica ambassador registration is permitted. In this case, the organiser, meaning the owner of the used account, is responsible that only those fulfilling the terms of use of Sectio chirurgica are permitted to the screening.
A public screening of media library content is subject to the explicit, written approval of the Institute of Clinical Anatomy and Cell Analysis. A registration as part of the so called lecture hall, group or Sectio chirurgica ambassador registration does not suffice. The permission, if granted, can be revoked by the Institute of Clinical Anatomy and Cell Analysis at any given time without reasons.
10. Legal consequences
The Institute of Clinical Anatomy and Cell Analysis informs that infringement of these terms and the terms of use in general can result in legal consequences, especially in injunctive relief and damage claims.
