1. Applic­a­bil­i­ty

The terms of use apply to all con­tent on the plat­form www.sectio-chirurgica.de of the Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis of the Uni­ver­si­ty of Tübin­gen.

2. Eth­i­cal and Moral Oblig­a­tion

At Sec­tio chirur­gi­ca, sur­gi­cal pro­ce­dures are demon­strat­ed on human spec­i­mens. Dur­ing their life­time, they willed their bod­ies to be donat­ed for the pur­pos­es of research and med­ical train­ing to the Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis of the Uni­ver­si­ty of Tübin­gen. The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis of the Uni­ver­si­ty of Tübin­gen is oblig­at­ed to com­ply with the eth­i­cal oblig­a­tions of the body donor pro­gramme and the agree­ment with the body donors.

3. Offered Con­tent

The web­site www.sectio-chirurgica.de is owned by the Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis of the Uni­ver­si­ty of Tübin­gen, Fac­ul­ty of Med­i­cine. Its con­tent is offered free of charge and restrict­ed.  It is direct­ed towards med­ical and med­ical­ly-relat­ed study pro­grammes and towards med­ical and med­ical­ly-relat­ed pro­fes­sion­als. The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis reserves the right to demand proof of the right of access in form of offi­cial doc­u­ments.

The access and use of media offered on www.sectio-chirurgica.de is sub­ject to the terms of use. Access and use will only be grant­ed if you express­ly agree to these terms of use.

4. Copy­right

The ser­vices offered on www.sectio-chirurgica.de, includ­ing infor­ma­tion, texts, soft­ware, images, videos, graph­ics, sound and oth­er mate­r­i­al are pro­tect­ed com­mer­cial­ly by copy‑, trade­mark and patent right. The copy‑, trade­mark, patent and exploita­tion rights belong exclu­sive­ly to the MFT and the respec­tive licensers. You oblig­ate your­self to com­ply with the legal require­ments of the copy‑, trade­mark and patent rights.

5. Place­ment and Amend­ment of the Terms of Use

a) The terms of use are avail­able online on www.sectio-chirurgica.de and as an attach­ment to the reg­is­tra­tion form dur­ing reg­is­tra­tion.

b) The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis reserves the right to amend the terms of use at any time. These changes become valid once they have been pub­lished online. By con­tin­ued use of the offered ser­vices you agree to the amend­ments to the terms of use and are bound by these terms.

c) The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis is able to amend or sus­pend the ser­vices offered or cer­tain fea­tures at any time with­out notice. It is able to restrict the use and the access to the offered ser­vices as well as the dura­tion and extent of use at any time, respec­tive­ly.

6. War­ran­ty and Prod­uct Lia­bil­i­ty

a) The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis pro­vides the sys­tems “as they are” to use. No par­tic­u­lar fea­tures are explic­it­ly guar­an­teed and nei­ther is the absence of errors nor the free­dom of rights of third par­ties war­rantied. It is not war­rantied that the plat­form is suit­able for the pur­pos­es of its users and that it works with exist­ing soft­ware. The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis is not liable for any dam­ages occur­ring because of the use of the plat­form.

b) The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis does not war­ran­ty the cor­rect­ness and com­plete­ness of the pro­vid­ed con­tents. The insti­tute is not liable for any dam­ages, direct or indi­rect, occur­ring because of incor­rect con­tent.

c) The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis does not guar­an­tee the back­up of uploaded con­tent. The user is respon­si­ble for an ade­quate back­ing up of the data. No war­ran­ty is giv­en in case of a loss of data and con­se­quen­tial dam­ages.

d) The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis does not war­rant the avail­abil­i­ty of any sys­tems or con­tents at a spe­cif­ic time or dur­ing a spe­cif­ic time­frame. The insti­tute is not liable for any dam­ages occur­ring because of a non-avail­abil­i­ty of the sys­tems or con­tents. How­ev­er, the Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis endeav­ours to keep down­time as low as pos­si­ble and that all fea­tures are always avail­able. 

e) You express­ly agree that the use of the sys­tems and the con­tents is at your own risk.

7. Reg­is­tra­tion and Account

a) The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis pro­vides infor­ma­tion, med­ical knowl­edge and train­ing videos for reg­is­tered users. You assure that the infor­ma­tion entered by you dur­ing reg­is­tra­tion is cor­rect and that you will update it as soon as any changes occur.

b) You assure that you will not pass your account-iden­ti­ty and pass­word on and agree that you are respon­si­ble for any actions regard­ing the pro­vid­ed ser­vices that have been per­formed using your user-id and pass­word. If you notice any kind of mis­use regard­ing your account infor­ma­tion, you are respon­si­ble for noti­fy­ing the admin­is­tra­tor imme­di­ate­ly.

8. Ter­mi­na­tion of User Rights

a) User rights are ter­mi­nat­ed if you delete your account.

b) The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis has the right to part­ly and com­plete­ly deny access to its sys­tems or ter­mi­nate your account if there is an infringe­ment of the terms of use or if the sys­tems are used, using your id and pass­word, either by your­self or a third par­ty, in a way which could be detri­men­tal to the insti­tute.

9. Use of Infor­ma­tion and Mate­r­i­al

a) The access and user rights grant­ed to you are non-trans­fer­able. You are allowed to use (e.g. read, down­load, print) the mate­r­i­al, except for video and livestream (see 9. d) for video con­tent), pro­vid­ed on the plat­form. This right is only for your own per­son­al use in the con­text of teach­ing, learn­ing and research. Com­mer­cial use is explic­it­ly exempt.

b) You promise not to copy, use, sell, trans­fer, pub­lish the mate­r­i­al for oth­er use or make it avail­able in any way. This includes exter­nal news­groups, mail­ing lists, elec­tron­ic bul­letin boards, Social Media and oth­er.

c) Com­mu­ni­ca­tion sys­tems (e.g. chat) are exempt from com­mer­cial use or from use dif­fer­ing from the objec­tive of the pro­vid­ed con­tent. The cir­cu­la­tion of email address­es of oth­er reg­is­tered users is pro­hib­it­ed.

d) Media library and livestream

The copy­right of the pro­vid­ed record­ings and livestreams lies with the Uni­ver­si­ty of Tübin­gen, Med­ical Fac­ul­ty, Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis.

The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis pro­vides con­tent on its plat­form www.sectio-chirurgica.de that can be accessed and watched by reg­is­tered and acti­vat­ed (by an admin­is­tra­tor) users.

The con­tent pro­vid­ed in the media library and in the livestream are pro­tect­ed by copy­right law. There­fore, stor­age or redi­rect­ing of said con­tain is not allowed.

Com­plete or par­tial inte­gra­tion of the con­tents of the media library and the livestream in oth­er ser­vices (e.g. chan­nels, web­sites, appli­ca­tions) is ille­gal. Addi­tion­al­ly, down­load­ing, edit­ing, copy­ing is not per­mit­ted.

Screen­ing of the livestream as part of a lec­ture hall, group or Sec­tio chirur­gi­ca ambas­sador reg­is­tra­tion is per­mit­ted. In this case, the organ­is­er, mean­ing the own­er of the used account, is respon­si­ble that only those ful­fill­ing the terms of use of Sec­tio chirur­gi­ca are per­mit­ted to the screen­ing.

A pub­lic screen­ing of media library con­tent is sub­ject to the explic­it, writ­ten approval of the Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis. A reg­is­tra­tion as part of the so called lec­ture hall, group or Sec­tio chirur­gi­ca ambas­sador reg­is­tra­tion does not suf­fice. The per­mis­sion, if grant­ed, can be revoked by the Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis at any giv­en time with­out rea­sons.

10. Legal con­se­quences

The Insti­tute of Clin­i­cal Anato­my and Cell Analy­sis informs that infringe­ment of these terms and the terms of use in gen­er­al can result in legal con­se­quences, espe­cial­ly in injunc­tive relief and dam­age claims.
